This is the Privacy Policy for GOENGLISH.COM.AU Pty Ltd trading under the brand name Goenglish.com.au. Goenglish.com.au reserves the right to change the Privacy Policy where deemed necessary. Any change to the Privacy Policy will come into effect immediately upon notification on the Goenglish.com.au website.

Personal Information

When you access the Goenglish.com.au website, information regarding your visit is recorded by our server or on our behalf by a third party. The client retains sole copyright, ownership and control over all materials submitted to Goenglish.com.au for proofreading and editing, including any materials subsequently created or developed by Goenglish.com.au.

The customer retains sole copyright, ownership and control over all materials submitted to Goenglish.com.au for proofreading and editing and within lessons, including any materials subsequently created or developed by Goenglish.com.au.

2. CONTENT OF SUBMITTED OR CREATED MATERIALS

Proofreading/Editing Service
Customers are advised that plagiarism and breach of copyright are serious offenses. Goenglish.com.au reserves the right to decline requests for price quotes from any potential academic clients whose job involves the reworking of plagiarized content. Where copyright infringement or plagiarism is discovered or suspected after a document has been accepted for editing, customers are advised that the editing will not proceed.
Goenglish.com.au reserves the right to refuse to proofread/edit or create any document that advocates or incites violence, hatred or discrimination in contravention of national and international laws.
The information contained in customer documents edited by this service may include opinions or views that are not those of Goenglish.com.au or any of person associated with Goenglish.com.au. Goenglish.com.au is not responsible or liable in relation to the use of any information contained in customer documents including misleading or defamatory statements, or the infringement of third party copyright.
Users of the Goenglish.com.au Website are prohibited from posting or transmitting to the site any material that is virus infected, unlawful, threatening, libelous, defamatory, obscene or pornographic, as well as any other material that would violate any laws.

3. SERVICE QUALITY AND STANDARDS

Proofreading/Editing Service
Goenglish.com.au aims to provide complete satisfaction for our customers through a quality Proofreading/editing service. All documents are proofread, edited or created to a high and exacting standard. We do not guarantee that edited documents are “perfect” and “error free”. Goenglish.com.au is not obligated to refund the cost of the service in the case of an edited document being less than perfect. We request that the customer contact us immediately if they are not completely satisfied with the service and we will make every effort to remedy the situation.
The customer is responsible for reviewing the edited document upon completion and contacting Goenglish.com.au should any errors be discovered.
Goenglish.com.au will correct any outstanding issues with a document if applicable.
ESL Lessons/Tutoring Services/Online Lessons
Goenglish.com.au aims to provide complete satisfaction for our customers by providing the highest quality ESL and Tutoring services. We cannot guarantee “test” results or “Academic” grades for customers, and Goenglish.com.au cannot be held responsible if the customer fails to meet any university degree, government visa requirement or employment English that they have attempted to attain by using our services.
Goenglish.com.au will not be liable for incidental, indirect, consequential, special, punitive or exemplary damages, including loss of revenues or profits, loss of business, loss of data, or the final academic grading of work related to this service. This exemption applies to any claim, loss or injury based on errors or omissions, interruptions or any other inaccuracies that may appear on the Goenglish.com.au website or in an edited customer document.

4. ACCURACY OF CLIENT INFORMATION

The customer is responsible for providing true and accurate information with respect to their name, address, phone number, email address, all payment details and any information as requested on the Student Enrolment form. Failure to provide correct and accurate information may result in a refusal to provide the service required. The customer assumes all responsibility for any problems, errors and issues, as well as legal liability resulting from such false information. All information submitted by the customer is confidential and secure. Please read our Privacy Statement and Security Information pages for more details.
ESL Lessons/Tutoring Services/Online Lessons
The customer is responsible for providing and agreeing to set times, places and dates for all lessons. Any changes to these arrangements must be made by the customer to Goenglish.com.au at least 24 hours before the lesson is to be held or cancellation fees may apply.

5. OWNERSHIP AND COPYRIGHT OF BUSINESS NAMES AND WEB SITE CONTENT

The Goenglish.com.au Website http://www.goenglish.com.au, any subsidiary websites and the business name GOENGLISH.COM.AU are owned and operated by GOENGLISH.COM.AU. All material on this site and subsidiary sites including services, images, policies, copy and prices are protected by international copyright and trademark law. These names and the Web site content cannot be used, copied, reproduced, republished, transmitted, framed, printed or modified without the express permission of GOENGLISH.COM.AU.

6. FINANCIAL FRAUD OR THEFT

Goenglish.com.au is not liable for the fraudulent use of any credit card or other payment method that may be used to purchase its services.

7. INDEMNIFICATION

The customer agrees to indemnify and hold Goenglish.com.au and anyone associated with Goenglish.com.au harmless from any claim or demand, including reasonable fees and costs for the service of an attorney, or as may be made by any third party due to, or arising from use of the site or service, or violation of the Terms and Conditions by the customer, or infringement of any intellectual property or other right of any person or entity by the customer.
Goenglish.com.au gives no assurances or warranty regarding the accuracy, currency or applicability of any of the Website contents in relation to specific situations and particular circumstances, and disclaims all liability with respect to such information.

8. TECHNICAL DISCLAIMER

Goenglish.com.au is not liable or responsible for service delays resulting from unforeseen circumstances such as technical problems including server or connection issues that are beyond our control. We will make every effort to meet deadlines and communicate with customers in the case of technical problems.
Goenglish.com.au is not liable or responsible for any damage to computer hardware or software arising from the distribution of a computer virus through the use of the Goenglish.com.au Website or system.

9. REFUSAL OR DENIAL OF SERVICE

Goenglish.com.au reserves the right to deny or refuse service to any customer or prospective customer for any reason and without explanation.

10. TERMINATION OF SERVICE AND CONTRACTUAL OBLIGATIONS

In the event a customer violates any or all of the Terms and Conditions contained in this document, Goenglish.com.au reserves the right to terminate all service and contractual obligations with the customer. Goenglish.com.au may, at its discretion, discontinue or terminate operation of its Website, services or trading name without notice at any time and for any reason.
Proofreading/Editing Service
A contract between Goenglish.com.au and the customer commences as soon as the customer has submitted payment for the service and the payment has been received by Goenglish.com.au. Once payment has been received, the customer is confirming that the work is to commence.
Should the customer wish to cancel the service once work has commenced, a credit will be applied to the customer’s account. Any refund of money paid is at the discretion of Goenglish.com.au and may incur any associated costs incurred by Goenglish.com.au, including bank/transfer fees and administrator costs.
The customer is responsible for providing accurate and descriptive requirements to Goenglish.com.au at the time of submitting a job, or prior to a quote being issued. These requirements form the statement of work. Failure by the customer to provide correct and accurate information in the statement of work may result in the cancellation of a transaction. Where a transaction is cancelled due to a breach of these terms and conditions, a refund will be offered to the customer of all money paid less any associated cost incurred by Goenglish.com.au including bank/transfer fees and editor costs. The customer assumes all responsibility for any problems, errors and issues, as well as legal liability resulting from an incorrect statement of work.
The focus of all work done by Goenglish.com.au is on remedying English grammar and spelling errors within a document. Form and content errors may be revised at the discretion of the Editor.
Goenglish.com.au reserves the right to cancel service to any customer when a virus is suspected in submitted documents. In the case of a transaction a refund will be issued less any associated cost incurred by, Goenglish.com.au including bank/transfer fees, editor costs and virus removal costs.
Goenglish.com.au reserves the right to cancel service to any customer for any reason and without explanation.
ESL Lessons/tutoring Services
A “Free Trial Lesson” is only offered at the discretion of Goenglish.com.au, and Goenglish.com.au reserves the right to terminate or cancel this service at any time.
All customers must complete the Enrolment Form, with payment before the commencement of any service provided by Goenglish.com.au.
All lessons will run for a minimum of 50 minutes, unless agreed to by both the tutor and the customer.
All cancellations or rescheduling of lessons by the customer, will be charged at the discretion of Goenglish.com.au, as dependent on any extenuating circumstances. 24 hours notice is required for all cancellations or fees may apply.
A lesson may be cancelled by the tutor if the customer is more than ten minutes late to begin the lesson, without notification. The customer will be charged accordingly. Credit will be given to any customer whose lesson or service is cancelled due to unforeseen circumstances involving the tutor, and their lesson or service rescheduled to a later date.
Goenglish.com.au reserves the right to cancel a service to any customer for any reason and without explanation.
Online Lessons
A “Free Trial Lesson” is only offered at the discretion of Goenglish.com.au, and Goenglish.com.au reserves the right to terminate or cancel this service at any time.
A contract between Goenglish.com.au and the customer commences as soon as the customer has submitted payment for the service and the payment has been received by Goenglish.com.au. Once payment has been received, the customer is confirming that the work is to commence.
All lessons will run for a minimum of 45 minutes, unless agreed to by both the tutor and the customer. Trial lessons will be a minimum of 30 minutes.
All cancellations or rescheduling of lessons by the customer, will be charged at the discretion of Goenglish.com.au, as dependent on any extenuating circumstances.
A lesson may be cancelled by the tutor if the customer is more than ten minutes late to begin the lesson, without notification. The customer will be charged accordingly. Credit will be given to any customer whose lesson or service is cancelled due to unforeseen circumstances involving the tutor, and their lesson or service rescheduled to a later date.
Goenglish.com.au reserves the right to cancel services to any customer for any reason and without explanation.

11. JURISDICTION

Goenglish.com.au is governed by the laws of the State of Queensland, Australia and by accepting these terms and conditions you submit to the jurisdiction of the courts in that state.

12. MODIFICATION OF TERMS AND CONDITIONS

The terms and conditions contained herein may be modified, amended, altered, changed, reorganized, rewritten or revoked at any time, for any reason and without notice.
